Terms & Conditions

1. General Information

These Terms & Conditions ("Terms") govern all services provided by Margherita Nutrition Coaching, operated by Margherita Laviani ("the Coach"). By booking a consultation or purchasing a programme, you confirm that you have read and agree to these Terms.

Margherita Laviani is a PN Level 1 Certified Nutrition Coach based in Zurich, Switzerland. All coaching services are provided for educational and lifestyle support purposes only and do not constitute medical advice, diagnosis, or treatment.

2. Scope of Services

Coaching focuses on nutrition education, habit building, and lifestyle support for healthy adults. Services are designed to support:

  • Healthier daily eating habits

  • Practical meal planning and routine strategies

  • Sustainable long-term habit building

  • General nutrition education and culinary skills

Coaching does not include:

  • Diagnosis or treatment of any medical condition

  • Clinical nutrition therapy or dietetic services

  • Treatment of eating disorders or disordered eating

  • Mental health therapy or psychological counselling

If you have a diagnosed medical condition or are under the care of a healthcare professional, please seek their advice before beginning any coaching programme.

 

3. Right of Withdrawal (Cooling-Off Period)

This section is required under EU and Swiss consumer protection law.

If you are a consumer (purchasing for personal, non-commercial purposes), you have the right to withdraw from a programme within 14 calendar days of purchase confirmation, without giving a reason.

To exercise this right, notify the Coach in writing by email to margherita.laviani@gmail.com within 14 days of the date of purchase.

Exception: If coaching sessions begin during the 14-day period at your explicit request, you acknowledge that you may lose the right to a full refund for sessions already delivered.

 

4. Initial Consultation

All programmes begin with a free 15-minute introductory consultation, designed to:

  • Understand your goals and current habits

  • Assess whether coaching is appropriate for your needs

  • Determine which programme, if any, is the right fit

This consultation is offered free of charge and does not constitute a binding commitment on either side.

5. Programmes & Payments

Following the introductory consultation, you may choose one of the available programmes. Programme details and pricing are confirmed in writing before purchase. Upon agreement, an invoice will be issued. Payment can be made via:

  • Bank transfer (IBAN)

  • Credit or debit card (where available)

  • Payment can also be made via TWINT (Switzerland only). TWINT payments are processed directly through the TWINT app and are subject to TWINT's own terms and privacy policy.

​Payments made by credit or debit card are processed securely by Stripe Payments Europe, Ltd., a third-party payment processor. Margherita Nutrition Coaching does not store or have access to your card details. Card data is processed by Stripe in accordance with PCI-DSS standards and their Privacy Policy (stripe.com/privacy).

Coaching commences once full payment has been received, unless a written instalment agreement has been made in advance.

6. Program Commitment

The Step Up and Peak Performance programmes require a minimum commitment of 6 months. This reflects the nature of the coaching process, which is built around long-term habit formation, behavioural change, and sustainable lifestyle integration.

The Start Simple programme is a single-session offering with no minimum commitment.

7.Program Renewal

The Step Up and Peak Performance programmes include automatic renewal after the initial 6-month period to ensure continuity of support.

  • You will be notified by email at least 30 days before the renewal date

  • To cancel, provide written notice by email at least 1 calendar month before the renewal date

  • Renewal is billed at the then-current programme rate

8. Cancellation Policy

After the minimum commitment period: You may cancel at any time with 1 calendar month's written notice. No further charges after the notice period.

Before the minimum commitment period ends: Early termination is not available except as described in Section 3 (Right of Withdrawal) or in exceptional circumstances at the Coach's sole discretion.

Exceptional circumstances: In the event of a serious documented medical condition or other compelling personal circumstance, please contact the Coach to discuss options. Decisions are made on a case-by-case basis.

9. Rescheduling and Missed Sessions

Sessions should be rescheduled with at least 24 hours' notice. Sessions cancelled with less than 24 hours' notice, or missed without notice, may not be eligible for rescheduling and may be counted as delivered.

10. Client Responsibility

Coaching is a collaborative process. The client is responsible for:

  • Actively applying agreed strategies and recommendations

  • Making their own personal food and lifestyle decisions

  • Communicating openly about progress, challenges, and feedback

  • Disclosing any relevant health conditions before or during coaching

11. Results Disclaimer

Nutrition coaching results vary from person to person. No specific health outcomes, weight changes, or performance improvements are guaranteed. Progress depends on individual circumstances, adherence, and engagement.

12. Client Photos and Progress Materials

Photos, progress images, or other personal materials shared during coaching are used exclusively for coaching purposes. They will not be published, shared publicly, or used for marketing without explicit written consent. Any use for testimonials or promotional content requires a separate signed consent form

13. Liability Disclaimer

All coaching services are provided for educational and informational purposes only. To the fullest extent permitted by applicable law, the Coach is not liable for any direct or indirect consequences arising from the application of information discussed during coaching, or from decisions made by the client regarding diet, exercise, or lifestyle. Nothing in these Terms limits liability for death or personal injury caused by negligence or fraud.

14. Confidentiality

All personal information shared during coaching is treated as strictly confidential and will not be disclosed to third parties, except where required by law.

15. Data Protection

Personal data is processed in accordance with the Swiss nFADP and, where applicable, the EU GDPR. Please refer to the full Privacy Policy on the website for details.

16. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

17. Changes to These Terms

These Terms may be updated at any time. The latest version will always be published on the website with a revised "last updated" date. Continued use of coaching services after an update constitutes acceptance of the revised Terms.
